But even as we serve you all, we make sure to value your privacy above all else and to keep it safe and secure. In order to fulfill our pledge, we maintain open and honest procedures for handling the data we gather from our users and how it is put to use. We process personal data in accordance with applicable laws and may share such information with authorised service providers or partners strictly for the purpose of operating and improving our platform.

All users who visit and use our websites or mobile applications created by Flickd are subject to this privacy statement. By visiting our website or mobile application and/or utilizing Flickd’s services, users herein unconditionally consent to the terms of use and privacy statement stated here. We are dedicated to protecting our users’ privacy in every way because we value it. This Privacy Policy, when read in conjunction with the “Terms of Use” posted on our website(s) or mobile application(s), governs any disputes with Flickd regarding privacy issues. 3.     PERSONAL INFORMATION

For the purposes of this Privacy Policy, “Personal Data” means any data about an individual who is identifiable by or in relation to such data and shall include information that may directly or indirectly identify a user of the Flickd platform.

Flickd may collect and process personal data from users in the course of providing access to and facilitating the use of its website, mobile applications, and related services. Such personal data may be collected either directly from users when they interact with the platform or automatically through technological tools used for operating and improving the platform.

The categories of personal data that may be collected include, but are not limited to:

a)     name, email address, phone number, and login credentials provided during account registration;

b)     profile information such as gender, age, location, and profile picture where voluntarily provided by the user;

c)     images uploaded by users or captured through camera-enabled features of the platform for the purpose of enabling the virtual try-on functionality;

d)     device and technical information including IP address, device type, browser type, operating system, and similar technical identifiers;

e)     transaction-related information including order details, purchase history, and payment status relating to products purchased through the platform;

f)      engagement and analytics data relating to user interaction with the platform, including browsing behaviour, feature usage, and engagement with content or product listings; and

g)     any information voluntarily provided by users while interacting with the platform, including communications with Flickd’s support team or feedback submitted through the platform.

The personal data collected by Flickd is used for the purposes of:

a)     providing and operating the Flickd platform and its services;

b)     enabling AI-powered virtual try-on functionality;

c)     facilitating product discovery, purchase transactions, and order management;

d)     improving platform performance, user experience, and service offerings;

e)     communicating with users regarding their accounts, transactions, or platform updates; and

f)      complying with applicable legal and regulatory obligations.

By accessing or using the Flickd platform and voluntarily providing personal data, users consent to the collection, storage, and processing of such data in accordance with this Privacy Policy and applicable law.

4.     PROCESSING OF IMAGES FOR VIRTUAL TRY-ON

Flickd provides an artificial intelligence enabled virtual try-on feature which allows users to upload images of themselves or use camera-enabled tools on their devices. Such images are processed using computer vision and machine learning technologies to generate visual representations of apparel products on the user.

The images uploaded by users are processed solely for the purpose of generating virtual try-on results and improving the performance and functionality of the platform. Flickd does not use such images for training generalized artificial intelligence models unless explicit consent has been obtained from the user.

5.     COOKIES

We may use “cookies” or comparable electronic tools to gather information in order to assign each user a unique, random number as a user identification (“User ID”) and to better understand each user's unique interests using their identified computer or mobile device. This will improve responsiveness for our user or users. Even if we set a cookie on your computer or mobile device, we won't be able to identify you unless you explicitly identify yourself (for instance, by registering).

Flickd may use third-party analytics tools such as Google Analytics or similar services to understand user behaviour and improve platform performance. These services may collect information such as device identifiers, browsing behaviour, and interaction patterns.

Additionally, a cookie cannot read information from your hard drive. There is no explicit use of “cookies” in the iOS and Android apps. However, third-party code and libraries that use “cookies” to gather data and enhance their services may be used on our Flickd website or mobile application. Users can identify when a cookie is being sent to their device and choose whether to accept or reject these cookies. However, the User(s) may not be able to utilize all or any of our services if they decide to reject our cookies.

Advertisers using the platform of our Website(s)/Mobile Application(s) of Flickd to advertise may also assign and use their own cookies to your browser, a process that we do not control.
Once the User(s) permit, We may obtain additional information such as list of apps installed on your device, device information, location, network carrier ("Information") available on your device, to personalize your experience and improve the app suggestions. This data may also be used at our end to take necessary business decisions.

We assure that all or any information of the User(s) shall not be shared with any third party and shall be purely utilized for enhancing each user experience and personalizing the services within Flickd networks.

Opting Out: In case any of the User(s) wish to opt out of storing cookies, the said user has an option to remove/block cookies in the corresponding internet browser's settings.
However, this may have a direct impact upon the corresponding User(s)'s experience of our services.

i.          Log File Information: It is necessary to inform and clarify our User(s) that:
We automatically collect limited information about your computer's or mobile's connection to the internet, mobile number/email address (if applicable), including your IP address, when you visit our Website(s)/Mobile Application(s) of Flickd.

ii.          Your IP address is a number that lets computers attached to the Internet know where to send you data- such as the pages you view.

iii.          We automatically receive and log information from your browser, including your IP address, your computer’s name, your operating system, browser type and version.

6.     INSTAGRAM INTEGRATION AND CREATOR-BRAND DATA

Flickd provides an optional feature for creators who wish to connect their Instagram accounts to the platform in order to enhance engagement and automate certain interactions with their followers. This integration is entirely voluntary and requires explicit consent from the creator via Instagram’s OAuth login. Once connected, Flickd may access information from the creator’s Instagram account, including profile details and media content, for the purpose of verifying the account and ensuring authenticity on the platform.

Additionally, Flickd may monitor comments on the creator’s Instagram posts where followers request product information or links, and may automatically generate context-specific responses to those comments. This automated response system is designed to assist creators in managing high volumes of engagement efficiently and to facilitate timely communication with their audience. Flickd will not post content or send messages on behalf of the creator without clear context or a triggering comment from a follower.

Creators retain full control over this integration and may revoke Flickd’s access to their Instagram account at any time, either through the platform settings in Flickd or directly via Instagram account settings. All data collected through this integration, including uploaded content, engagement analytics, and other creator/brand-specific metrics, will be processed solely for the purpose of improving the functionality, performance, and user experience of the Flickd platform. Flickd does not use this data for any purpose outside the scope of platform operations and analytics, and such processing is conducted in accordance with applicable privacy laws, including the DPDP Act, 2023.

7.     INFORMATION FROM OTHER SOURCES

i.          We may receive information about you from other sources, add it to our account information and treat it in accordance with this Privacy Policy.

ii.          If you provide information to the platform provider or other partner, whom we provide/receive services from, your account information and order information may be passed on to us.

iii.          We may obtain updated contact information from third parties in order to correct our records and fulfill the services or to communicate with you.

iv.          Flickd may also receive product catalogue data, brand information, or transactional details from brands or merchants who list their products on the platform.

8.     DEMOGRAPHIC AND PURCHASE INFORMATION

i.          We may reference other sources of demographic and other information in order to provide you with more targeted communications and promotions. We use Google Analytics, among others, to track the User(s) behavior on our Website(s)/Mobile Application(s).

ii.          Google Analytics specifically has been enabled to support display advertising towards helping us to gain understanding of our User(s)’s Demographics and Interests.

iii.          The reports are anonymous and cannot be associated with any individual personally identifiable information that you may have shared with us.

9.     LINKS TO THIRD PARTY SITES / AD-SERVERS

Our Website(s)/Mobile Application(s) of Flickd may also include links to other third party websites or mobile applications. Such websites or mobile applications are governed by their respective privacy policies, which are beyond our control.

The User(s) can determine their position by looking at the URL in their browser's location bar after they move to third-party apps or websites and use any built-in third-party services. The privacy policy of the relevant operator of the application or website that the user is visiting governs how any information that the user provides to such a third party is used. That policy might not be the same as ours. For additional information about this and/or other complaints, users should get in touch with the proprietors of the application or website if they are unable to access the privacy policy of any of these third-party websites or mobile applications, including their homepage.

We typically provide aggregated statistics on traffic to different pages and content within our Website(s) and Mobile Application(s) of Flickd to our advertisers in order to help them understand our audience and validate the value of advertising on these platforms.

i.          When the law, a court, a government agency, or an authority requests or requires disclosure, whether for identification verification, prevention, detection, or investigation (including cyber events), or for the prosecution and punishment of offenses. These disclosures are provided in good faith and with the belief that they are reasonably required to enforce the Terms of Use and Privacy Policy, as well as to comply with applicable laws and regulations at the relevant time.

ii.          In order for Flickd to process Personal Information on its behalf, it plans to communicate this information with its group companies, related firms, and their officers and employees. Payments made through the Flickd platform are processed through authorised third-party payment gateway providers in accordance with applicable financial and regulatory standards. Flickd does not store complete credit card or debit card information on its servers.

12.  USER RIGHTS UNDER THE DIGITAL PERSONAL DATA PROTECTION ACT, 2023

Flickd respects and upholds the rights granted to users under the Digital Personal Data Protection Act, 2023 (“DPDP Act”). Users have the right to exercise control over their personal information (“PI”) collected and processed by Flickd, subject to applicable legal and contractual obligations.

Access and Correction: Users have the right to access their personal information held by Flickd at any time. This includes the ability to view the details provided during account registration, transactional information, and any other data collected while using the platform. Users may also request corrections or updates to ensure that their personal information is accurate, complete, and current. Requests for access or correction will be processed promptly, and Flickd will take reasonable steps to verify the identity of the requesting user before granting access or making modifications.

Consent Withdrawal: Where processing of personal information is based on user consent, such as optional features including Instagram integration, users have the right to withdraw their consent at any time. Withdrawal of consent will not affect the lawfulness of processing that was conducted prior to withdrawal. Users may revoke access or permissions through Flickd’s platform settings or, where applicable, via the settings of the integrated third-party service.

Users may nominate another individual who shall exercise their rights in relation to their personal data in the event of death or incapacity.

Deletion: Users may request the deletion of their personal data from Flickd’s servers, subject to legal, regulatory, or contractual retention requirements. Upon receiving a deletion request, Flickd will take reasonable steps to remove the user’s personal information from active databases and relevant third-party service providers, while maintaining necessary backups for residual legal or operational purposes.

Objection to Processing: Users have the right to object to the processing of their personal information for specific purposes, including profiling, marketing, or other optional features. Flickd will consider and respond to such objections in accordance with applicable laws and will cease processing the user’s personal information for the objected purpose, unless otherwise required or permitted by law.

If a user’s grievance is not resolved satisfactorily, the user may escalate the matter to the Data Protection Board of India in accordance with the provisions of the Digital Personal Data Protection Act, 2023.

13.  ACCESSING, UPDATING AND DELETION OF PERSONAL INFORMATION

When the User(s) use our Website(s)/Mobile Application(s) of Flickd:

i.          We work in good faith to give our users access to their personal information upon request from the user or users. We also make sure that any personal information or sensitive personal data or information that is discovered to be inaccurate or lacking is updated, changed, or amended as soon as possible, subject to any legal requirements that such information be kept on file or for valid business purposes.

ii.          Prior to processing any requests, we ask each individual User to identify themselves and the information they would like accessed, corrected, or removed. We may also refuse to process requests that are excessively repetitive or systematic, require a disproportionate amount of technical work, compromise the privacy of others, would be highly impractical (such as requests involving information stored on backup tapes), or for which access is not otherwise necessary.

iii.          Unless doing so would necessitate an excessive amount of work, we always provide information access and correction at no other cost. (iv) We may guarantee that Personal Information pertaining to a User or Users is removed from both our database and third-party cloud service providers upon receiving a particular request from any of the User(s).

iv.          Due to the manner in which we manage some of our services, residual copies of your personal information may be kept in our backup systems for a while after you request that they be removed from our active servers.

14.  DATA RETENTION

Flickd retains personal data only for as long as necessary to fulfil the purposes for which such data was collected, including compliance with legal, accounting, or regulatory obligations. Uploaded images used for virtual try-on may be deleted after processing or retained for a limited duration for operational purposes.

15.  OUR POLICIES CONCERNING CHILDREN

We don't intentionally gather or ask for personal information from anyone under 18 years of age or let them to utilize our services. Please do not provide us with any personal information, such as your name, address, phone number, or email address, if you are younger than sixteen. No personal information may be submitted by anyone younger than sixteen. We will take immediate action to remove any personal information we may have obtained from a child under the age of sixteen. Please get in touch with us if you think we may have any information from or about a child under the age of sixteen.

16.  DATA SECURITY
